Job CONDITIONS

Requirements

  • Must have the ability to diagnose, analyze and solve complex problems.

Education and Experience:

  • JD required
  • Admitted to practice law in California and eligible for pro hac vice admission in other jurisdictions required
  • 3-5 years of experience litigating coverage disputes required, preferably in the A&H field
  • Substantial experience drafting pleadings and motions; conducting research and discovery; and preparing for and handling depositions, mediations and trial preparation required
  • Trial experience strongly preferred
  • ERISA litigation experience strongly preferred
Denver, CO salary range: $123,900 - $145,800


 

Role Description

We currently have an opportunity for a Coverage Litigation Attorney to join our Claims team in our Plymouth, MN; Denver, CO offices or remotely nationwide. Provides legal representation to Intact in primarily Accident & Health (A&H) coverage disputes before courts, arbitration panels, or other bodies and advises claim employees in their handling of litigated coverage matters. Responsible for litigating a coverage file caseload independently, including preparing a litigation strategy; drafting pleadings and motions; and attending conferences, depositions, oral arguments, and trials, whether in-person or remotely.

Responsibilities:

  • Handles a consistent workload of primarily A&H coverage files representing Intact.
  • Responsible for maintenance and completion of caseload and trial work of some complexity.
  • Works on all aspects of litigated files including discovery, depositions, motion practice and trial.
  • Recommends and conducts all appropriate legal action to best protect the interests of the company on all assigned cases in an ethical and zealous manner. Prepares appeals and performs necessary research on motions.
  • Appropriate authority to negotiate settlements with opposing counsel.
  • Interfaces and provides counsel and timely status updates to claims staff.
  • Timely prepares reports as required and schedules/attends meetings with claims staff to review pending litigation/strategy.
  • Maintains a strong professional knowledge of legal environments and applies this information effectively.
  • Directs paralegals and other staff in the production of documents, file management and other projects as necessary.
